APP TERMS OF USE

These Terms of Use govern your access to and use of the Gnurl mobile application (the "App") published by Redders IT Pty Ltd ("we", "us" or "our"). By downloading, installing, or using the App you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.
DEFINITIONS
In these Terms of Use:
- "App" means the Gnurl mobile application published by Redders IT Pty Ltd, including any updates or new versions.
- "Content" means all text, graphics, images, software, code, game design, audio, and other material forming part of the App.
- "You" means the individual accessing or using the App.
- "We", "us", "our" means Redders IT Pty Ltd.
ACCESS AND USE OF THE APP
Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on a device that you own or control, solely for your personal, non-commercial purposes. This licence is subject to the terms of the End User Licence Agreement set out in Part 2 of this document.
You must be at least 4 years of age to use the App, or if you are under the age of majority in your jurisdiction, you must have parental or guardian consent. By using the App you represent that you meet this requirement.
ACCEPTABLE USE
You agree not to:
- use the App for any unlawful purpose or in any way that violates applicable laws or regulations;
- attempt to decompile, reverse engineer, disassemble, or otherwise derive source code from the App;
- remove, alter, or obscure any proprietary notices (including copyright and trademark notices) in or on the App;
- use the App in any manner that could damage, disable, or impair the App or interfere with other users' enjoyment of the App;
- attempt to gain unauthorised access to any systems or networks connected to the App.
INTELLECTUAL PROPERTY
The App and all Content are owned by or licenced to Redders IT Pty Ltd and are protected by Australian and international intellectual property laws, including copyright and trade mark laws. All rights not expressly granted in these Terms of Use are reserved by us.
"Gnurl" and associated logos and branding are trade marks or unregistered trade marks of Redders IT Pty Ltd. You may not use our trade marks without our prior written consent.
MODIFICATION OR DISCONTINUATION OF THE APP
We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice, and without liability to you. We may also update these Terms of Use at any time. Your continued use of the App following any update to the Terms of Use constitutes your acceptance of the revised terms.
LIABILITY
To the maximum extent permitted by applicable law, the App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, Redders IT Pty Ltd will not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of (or inability to use) the App, including loss of data, loss of profits, or any other losses, even if we have been advised of the possibility of such damages.
Nothing in these Terms of Use is intended to exclude, restrict, or modify any consumer rights under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified.
GOVERNING LAW
These Terms of Use are governed by the laws of Australian Capital Territory, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Australian Capital Territory in respect of any dispute arising out of or in connection with these Terms of Use or the App.

END USER LICENCE AGREEMENT (EULA)
This End User Licence Agreement ("EULA") is a binding legal agreement between you ("End User") and Redders IT Pty Ltd ("Licensor") for your use of the Gnurl App. This EULA supplements the Terms of Use above. In the event of any inconsistency, this EULA prevails to the extent of the inconsistency.
1. Definitions
In this EULA:
- "App" means Gnurl, the sliding puzzle mobile application published by Redders IT Pty Ltd.
- "Device" means any compatible iOS or iPadOS device you own or control on which you install and use the App.
- "Licensor" means Redders IT Pty Ltd.
- "App Store" means the Apple App Store through which the App is distributed.
2. Licence Grant
Subject to your compliance with this EULA, the Licensor grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on any Device that you own or control, solely for your personal, non-commercial entertainment purposes. You may not sub-licence, sell, resell, transfer, assign, or otherwise dispose of this licence or the App.
3. Licence Restrictions
You must not:
- copy or reproduce the App except as permitted by this EULA or applicable law;
- modify, translate, adapt, or create derivative works based on the App;
- reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent permitted by applicable law;
- rent, lease, lend, sell, redistribute, or sub-licence the App;
- remove, circumvent, disable, damage, or otherwise interfere with security features of the App;
- use the App to develop a competing application or service.
4. Ownership
The App is licenced to you, not sold. The Licensor and its licensors retain all right, title, and interest in and to the App, including all intellectual property rights therein. You have no rights in or to the App other than the right to use it in accordance with this EULA.
5. Updates and Upgrades
The Licensor may from time to time release updates, upgrades, patches, or new versions of the App ("Updates"). Updates may be distributed through the App Store and may be downloaded automatically depending on your device settings. This EULA applies to all Updates unless a separate licence is provided with an Update. The Licensor is under no obligation to provide Updates.
6. Privacy
The App does not collect personal information from End Users. Your use of the App is subject to the Gnurl App Privacy Policy available at gnurl.app/privacy. By using the App, you acknowledge that you have read and understood the Privacy Policy.
7. Third-Party Terms
The App is distributed through the Apple App Store and Google Play Store. Your use of the App Stores is governed by Apple's and Google's Terms of Service. You acknowledge that Apple or Google has no obligation to provide maintenance or support services for the App. In the event of any claim by a third party that the App or your possession or use of the App infringes a third party's intellectual property rights, the Licensor (not Apple or Google) is solely responsible for the investigation, defence, settlement, and discharge of such claim.
8. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without warranty of any kind. The Licensor expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement.
The Licensor does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components, or that defects will be corrected.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will the Licensor be liable to you for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with this EULA or your use of (or inability to use) the App, even if the Licensor has been advised of the possibility of such damages.
To the maximum extent permitted by law, the Licensor's total liability to you for all claims arising out of or relating to this EULA or the App shall not exceed the amount you paid for the App.
Nothing in this EULA is intended to exclude any rights you may have under the Australian Consumer Law that cannot lawfully be excluded.
10. Indemnification
You agree to indemnify, defend, and hold harmless the Licensor and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your breach of this EULA or your use of the App in violation of applicable law.
11. Term and Termination
This EULA is effective from the date you first download or use the App and continues until terminated. Your rights under this EULA will terminate automatically without notice from the Licensor if you fail to comply with any of its terms. Upon termination of this EULA, you must cease all use of the App and delete it from all your Devices.
The Licensor may also terminate this EULA at any time by ceasing to make the App available.
12. Governing Law and Jurisdiction
This EULA is governed by the laws of Australian Capital Territory, Australia. Any dispute arising out of or in connection with this EULA shall be subject to the non-exclusive jurisdiction of the courts of Australian Capital Territory, Australia. If you acquired the App in the United States, you agree that any dispute with the Licensor will be resolved in accordance with the laws of Australian Capital Territory, and you irrevocably consent to such jurisdiction.

This EULA, together with the Terms of Use above and the Privacy Policy, constitutes the entire agreement between you and the Licensor with respect to the App and supersedes all prior or contemporaneous understandings regarding its subject matter. If any provision of this EULA is held to be unenforceable, such provision shall be modified only to the extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
